How foreclosure works in Georgia, and how selling can stop it
Most Georgia foreclosures are non-judicial, which makes them among the fastest in the country. The lender must mail the homeowner a notice at least 30 days before the sale and advertise it in the county's legal newspaper once a week for four weeks. The sale then happens on the courthouse steps on the first Tuesday of the month. Georgia gives no right to buy the home back after a non-judicial sale, so selling or paying off the loan before the sale date is the main way to keep your equity.

The Georgia foreclosure timeline
- Missed payments. Federal mortgage servicing rules generally keep servicers from starting foreclosure until a loan is more than 120 days behind.
- Notice of sale. The lender's attorney mails a notice at least 30 days before the sale date. It must name the person or company that can modify the loan.
- Four weeks of ads. The sale is published weekly for four weeks in the newspaper that carries legal notices for your county.
- Courthouse sale. The house is auctioned on the first Tuesday of the month between 10 a.m. and 4 p.m. If that day is New Year's Day or July 4, the sale moves to the Wednesday.
- After the sale. The buyer can begin eviction. Georgia doesn't let you redeem the home after a non-judicial sale.
Your options before the sale date
- Catch up or modify the loan. Many loan documents allow reinstatement. Call the servicer named in your notice.
- Sell the house. A sale pays off the loan at closing, and any equity above what you owe goes to you, not the bank.
- Short sale or deed in lieu. If you owe more than the house is worth, the lender may accept less or take the deed back.
- Talk to a lawyer. A Georgia attorney can tell you whether bankruptcy or another option fits your situation.
Why selling before foreclosure matters
At a foreclosure auction, the house often sells for far less than market value, and your equity can disappear. If the sale doesn't cover the debt, Georgia lenders can seek a deficiency judgment for the difference after the sale is confirmed by a court. Selling first lets you control the price, pay off the loan, and keep the rest.
A cash sale can close in as little as 7 to 14 days, which is often fast enough even after the notice has arrived. The sooner you call, the more options you have.

Questions
Common questions
How long does foreclosure take in Georgia?
Because most Georgia foreclosures are non-judicial, the process can move from the notice of sale to the auction in about 30 to 60 days. The full process from the first missed payment is often a few months.
Can I sell my house after getting a foreclosure notice in Georgia?
Yes. You can sell any time before the foreclosure sale. The closing attorney pays off the lender from the sale proceeds, and the foreclosure is cancelled.
Do I get my house back after a foreclosure sale in Georgia?
No. Georgia has no statutory right of redemption after a non-judicial foreclosure sale. Once the sale happens, the house is gone, which is why acting before the sale date matters.
